One month out of warranty battery died with it plugged in

what’s the odds of getting a battery without charging me?

    For an oem Acer laptop battery to lock up and have no charge after 13 months (which must have happened if the battery died) its more than a battery problem, as your laptop must have a main power rail fault or a BQ chip or a charging fault, as and if a battery doesn't charge and reaches its min charge for a long period of time, it will lock up.

    Also and after 13 months there is no way that Acer would change the battery for no charge. I strongly suggest that you take your laptop to a technician that has experience in fixing batteries and laptops charging rails and has a tool similar to an NLBA1 PRO Laptop battery analyser that can fix and unlock the battery (as a 13 months old battery is still new) and also analyse and fix your laptop, as that is what you need to do.
