Acer predator xb271hu stuck at 24hz

I bought a Acer Factory Certified Refurbished XB271HU and plugged it in December 2nd, 2020. I have a nvidia 2070 super and will not go over 24hz with display port. I can get 60hz with an HDMI. I have tried to
1. change overclock settings and restart.
2. 3 different display cables, (most recent one is a Accell 1.4 display cable.)
3. tried to change settings in windows and nvidia control pannel.
4. plugged Monitor power cable directly into the wall.
5. tried all display ports on GPU.
6. Unplugged my other monitor
Please let me know if there is something I am missing or do I just need to send it back in to get it fixed.
NOTE: on start up the monitor displays 60hz and as soon as windows starts it goes to 24 hz

    What resolution are you using? Will it accept faster refreshes if you drop resolution to something like 1080P? It's be nice to prove it's not just a setting that's wrong before sending it in for repair or replacement.

    I tried every resolution, only one that would give me 60hz was 800 which no way in hell I was using that. Even at 1080 it was going at 24 hz. Trust me I tried every trouble shooting option I could find on the internet. I returned it, only thing I could think of is a faulty panel or even gsync was messing it up, but even then I turned off gsync and that didn’t help either

    Gotta be a faulty monitor I was using an Accell 1.4 cable which is EVGA certified so
