Need replacement for notebook purchased 4 days ago, under warranty, Acer claims can't do this...!

I just bought this item off a very large website:

The laptop came in box that wasn't sealed, it's been tampered with 100%, windows 10 is even installed on it.

The screen has a flicker when you move the mouse at the lowest display brightness level, so this is a manufacturing defect, not sure why they shipped me a laptop in open package, but I suspect another customer bought it before, and returned it. So they sold me a returned item...

But anyways, I contacted Acer, and they confirmed that my warranty is good for a year form my date of purchase.

Problem is, I called Acer Thailand, and they said they only repair during warranty period ( I suspect incompetent employee?) ...shouldn't I be allowed to get an exchange for a new model within 7 days or so?

Acer Thailand tries to blame the dealer for that responsibility, but the problem is, the dealer is dishonest, and they don't have stock of that particular model anymore...

I absolutely love this machine, paid for it expecting new, I don't want a refund, I don't want it sent for repair, I simply want another one.

If anybody at Acer is listening...please help me, I bought this on April 18, I only have until the 24th to return it...

    Hi,
    I am sorry that you are in such situation, I would say that you need to return the product to the retailer for a refund, Acer warranty covers only the repairs as far as I know, please wait for other members' advice as well.

    There is no "exchange" policy if item is defective?
