Failing touch screen

Bought an Aspire R-5 in June.  It's been great until now.

The touchscreen started recording phantom touches, then I noticed a cosmetic crack in the right hand side of the display.  I didn't abuse or damage it in any way- the hairline crack just showed up.  You can't feel it with your finger.

Now acer is accusing me of being the cause of the damage, and advising me that I'll need to pay the $310 USD to fix the screen on a computer I just bought brand new for $700.

I'll need to send it off for 2 weeks to see what their technician makes of it.  Took me an online chat session and 4 phone calls to get a straight answer from Acer as to what my options were.

I'm pretty dissatisfied.  They seem awfully quick to blame me, the customer, and then charge me 50% of the original price to fix their defective product.

Has anyone successfully convinced Acer that the their touchscreens just fail sometimes?
