acer 314 chromebook touchscreen stopped working after reopening it?

so i got my acer 314 chromebook with touch screen (it even has the little sticker on the bottom right) 

so when i first opened it, it worked the touch screen worked and it was good. Then after a while i let it charge and it stopped working when i opened it again. I googled it and i saw an old post saying i have to update it, which i did. It is now on chrome os 93 or so and it's up to date but the touch screen still doesnt work. I factory resetted/powerwashed the chromebook and still nothing. I tried to do something in chrome flag but i'm not so sure which setting i have to play around with to make the touch screen work. Should i just refund it and get a new one?

If the factory reset and the power wash did not help in this means it will be a hardware issue,
