Can't update bios for battery charging issue because bios says it needs 25% and I'm at 6%

Hello all, my Nitro (an517-51) has the dreaded charging issue.  I tried the battery reset and got no results so I was moving to what looks like the next step in the forums, update bios.  I originally tried to update just to the battery bios update and then to the current one but neither works because the bios update pops up a message that says I need to charge the battery to at least 25% for it to work and I'm at 6% so it kicks me out whether I click the x or the ok box on the pop up.  Anyway to get around this or how am I supposed to update?  Do I need to return it?  I received it in April 2020.

    If you are not able to charge the battery full, then better contact Acer support for repair or replacement.

    Died on the last day of my 90 day warranty but I was out of town :(

    90 days? Isn`t the standard warranty an year or two?

    I thought it was one year. I bought it from acer on ebay but apparently that's only 90 days. I was doing a lot of research on the computer itself so I think I saw the 1 year warranty on acer's site but it was purchased on ebay and looking over there it shows 90 days :(

    I did. I says purchase date 3/20 something 2020 for the purchase date and the end of warranty date (which is wrong, it should say 6/20 something) but I didn't receive the laptop until 4/5. I let it sit 3 days for covid concerns, then I didn't tlrealize the box had a false bottom so I thought they didn't ship me a charging cord. So I didn't run it for a few days (let's call it April 11th). But I can contact acer support because it kicks me out. I don't have a receipt to upload to 'contest' purchase date either. Though I guess I can just upload my details and an ebay screenshot.
