why is my battery stated 3hrs and 10mins then the next 4 minutes it says 2 hours and 32mins

It's quite normal, it depends on what you do, did you charge the battery before you start using? The time shown is calculated according how much power your programs use and not forgetting background processes, for example, just open few more tabs in your browser, the time shown will reduce immediately.

If you are still not happy, you can do a battery reset and if that doesn't help, return it for replacement or refund but it depends on the retailer's refund policy in your region.
